Glenn Beck Slammed In Lengthy WIPO Screed

Internet satirists parodied Glenn Beck's "prove you don't beat your wife" rhetoric by questioning Beck's refusal to deny rumors that he had raped and killed a young girl in 1990. Instead of denying the rumor, Beck sued for the domain name in a WIPO administrative proceeding, claiming that the website infringed his trademark "Glenn Beck." Marc J. Randazza, a noted Internet lawyer, represented the respondent and wrote a withering response to the complaint. Money quote:

We are not here because the domain name could cause confusion. We do not have a declaration from the president of the international association of imbeciles that his members are blankly staring at the Respondent’s website wondering “where did all the race baiting content go?” We are here because Mr. Beck wants Respondent’s website shut down.


Perry Wants Military To Overthrow Obama

In an article for NewsMax, John L. Perry predicts that the military will overthrow President Obama. In Perry's estimation, military officers are so disgusted with Obama that there would be a groundswell of support within their to get rid of the President. Apparently, socialism is such a risk that martial law is preferred. So John Perry says that American military officers who swore to defend the Constitution would overthrow a democratically-elected President. Of course, it's all poppycock, and Perry is insane for thinking such things, but it is interesting insight into how the right wing works.

Woody Allen, et al., Seek Polanski's Release

Woody Allen was one of 138 Hollywood luminaries who signed a petition demanding the release of Roman Polanski, the famous film director who was recently arrested in Switzerland for plying a thirteen-year old girl with alcohol and drugs before sodomizing her some thirty years ago. Allen controversially married his step-daughter, causing the breakup of his marriage with Mia Farrow.

Favre's Last-Second TD Beats 49ers

Without a timeout, Brett Favre marches the Vikings 80 yards down the field to score a game-winning 32-yard touchdown with 0:02 on the clock. The Vikings beat the 49ers in dramatic fashion, 27-24. Favre eludes pass rushers to get the pass off, looking very sprite for an older gentleman.

Yanks Sweep Sox To Clinch AL East

A strong start by Andy Pettite, who appears to be healthy going into the playoff, led the Yankees to a 4-2 victory over the Red Sox. Brian Bruney pitched effectively, retiring each of the five batters he faced. The Yankees are the first AL team to clinch their division.

Gmail Down Again

Gmail was down today starting at 10:29 AM. Just like the last interruption, I was able to access my account through IMAP on Outlook, and my Blackberry faithfully kept on pushing Gmail. However, it was annoying to be unable to use the web mail interface, and the contacts and chat programs are still unavailable. The Google Apps Status Dashboard reports that the service should be up for most users as of this moment. However, that means some users have been deprived of email access for more than two-and-a-half hours.

Zazi Charged In Bomb Plot

Najibullah Zazi was indicted today in Brooklyn for participating in a bomb plot. According to the indictment, he was found with bomb-making instructions, and had tried to acquire materials to make the peroxide-based explosives that were used in the London bus bombings. Zazi searched the Internet for a source of muriatic acid in Flushing, Queens.

Furthermore, it appears that a Queens imam, Ahmad Wais Afzali, who was helping the FBI suddenly changed his mind and tipped off Zazi that the feds were after him. This apparently forced the FBI and the NYPD to nab Zazi sooner than they preferred.

It's scary to see terrorists in our backyard. At the same time, it feels oddly nice to have the FBI and NYPD pursue them as criminals pursuant to the letter of the law rather than shipping them off to some dark dungeon for torture.

Somali Suicide Bombers From America

At least three Somali who had lived in America have turned up dead in terror attacks in Somalia. One of them, Shirwa Ahmed, was a naturalized American citizen who blew himself up along with twenty-nine others in Somalia last fall. Ominously, more than a dozen Somalis living in Seattle, which has a sizable Somali population, have disappeared. 


This news only confirms that the risk of home-grown terror is real. Najibullah Zazi has reportedly admitted to receiving training in weapons and explosives in Pakistan. The FBI and the NYPD raided a house three avenues away from me to look for Zazi. Too close to comfort.

Nextiva VOIP: Jitter Settings

Our fax machine worked well with Nextiva VOIP but suddenly became unreliable. Sometimes it would work, sometimes it wouldn't. That's not good for business. Up to this point, Nextiva has been great in keeping in touch with me. I got an e-mail from one of their employees asking about my experiences so far. I told them that I had some problems. They were more than happy to help me resolve them. Here's their advice.

Don't Copy That: Racist Scare Ad?

The Software & Information Industry Association (SIAA) released a sequel to Don't Copy That, a music video instructing the public not to illegally copy software or risk jail-time. As they put it, "it's not a copy, it's a crime." What happens if you make a copy? Jackbooted thugs kick down your door and drag your mother away in the dark as she's making spaghetti. What happens to you? You get sent to jail, where three black men will beat the crap out of you.

Yes. Three black men. You might say that the video can't be racist, as the protagonist is black. Excuse me, but he's a black rapper. So this video endorses the view that Asians are computer dorks who steal software, and blacks are either rappers or violent thugs.

Optimizing Your VOIP Phone

My firm uses Nextiva VOIP for our office phones. The monthly charges are half of what Verizon wants for standard POTS lines, so the price is definitely right. Nextiva also offers advanced features such as an auto-attendant that connects callers to the person they seek. I initially had some problems with VOIP but they were easily be fixed by tinkering with my router.

Lethal Injection Fails

A condemned inmate was granted a one-week reprieve after his would-be executioners failed to find a vein suitable for a lethal injection after hours of searching. Romell Broom was sentenced to death after he was convicted of raping and murdering a fourteen-year old girl.

A lethal injection of a bullet wouldn't require finding a suitable vein. Just saying.

Odd Day At The Office

Today marks the first month in the office. We're renovating the office at the moment. At least the banging stopped. There's only painting left to do. And installing the door, which had to be trimmed and lacquered first.

Incidentally, yesterday marked the first time we deposited client monies into our operating account. For non-lawyers out there (or unethical lawyers), retainers have to go into the client trust account. Earned fees can be transferred into the operating account. The unearned portion of the retainer has to be returned. We finally sent out some bills and transferred money into the operating agreement.

Overall, this should have been a great day but the Nextiva VOIP phones have not been working well after Verizon downgraded our service. That's really annoying the heck out of me.

Well, there's always tomorrow.

US Commandos Kill Al Qaeda Guy In Somalia

An American Special Forces team took out Saleh ali Saleh Nabhan, a senior al Qaeda operative who was suspected of bombing the US embassies in Kenya and Tanzania ten years ago. A helicopter carrying the commandos took off from a Navy warship, shot Nabhan from the air, then landed to recover his body so that his identity could be confirmed. President Obama authorized the shoot and snatch operation.

Body Thought To Be That Of Missing Yale Student

A body found inside the walls of a Yale University building was believed to be that of Annie Le, a student who was supposed to have been married today. I hope they catch whoever killed her.

Jets' Mark Sanchez Impressive In NFL Debut

Mark Sanchez, the Jets' rookie quarterback threw for 272 yards in his NFL debut to lead his team to a 24-7 victory over the Texans. Sanchez threw an interception that was eventually returned for a touchdown, but was otherwise brilliant. He showed off his arm by throwing a 30-yard bomb to Chansi Stuckey for a touchdown.

The Jets' stout defense is a great sign. They did not allow a touchdown.

The Jets play the Patriots next week. All eyes will be on Sanchez as he takes on his team's arch-nemesis.

I hiked the Catskills yesterday with some of my friends. We took the Devil's Path to Indian Point, then returned along the Jimmy Dolan Trail. I took these pictures before my camera burst into smoke, which made me disinclined to take many more photos.

My Canon SD880 IS Smokes

The flash unit on my Canon SD880 IS started smoking when I took photos. It was pretty disconcerting.  I had the unit repaired two months ago because the SD card somehow got stuck in the unit. Now it's starting to emit smoke. It's still under warranty, so the repair should be covered. However, the warranty expires in October. I do not feel good about this purchase so far.

I did take some great photos with the camera, though.

Norman Borlaug Died

Norman Borlaug, an agronomist who was awarded the Nobel Peace Prize in 1970 for his work, died yesterday at the age of 95 of cancer. His discoveries in the field of high-yield strains of crops have saved an estimated 245 million people from famine and starvation. Amongst other work, Borlaug helped double the wheat yield in Mexico, Pakistan, and India by introducing new strains of wheat along with new farming techniques.

Borlaug had tried to enlist in the military during World War II, but was not allowed to because of his scientific skills. It's a scary thought on what would have happened had he been allowed to enlist.

Before that, I earned bachelor degrees in biochemistry and economics from New York University. After law school, I worked as a patent litigation associate at Ropes & Gray. Again, this website is my own personal website. I discuss items that I feel are interesting, which usually are not legal topics. For small law firms, Google Voice can be a very useful tool. The basic functionality of Google Voice is that it provides you with a phone number that forwards calls. There are other features such as voice mail transcription, call recording, and listening in on voice mails that are very useful for attorneys.

Clijsters Nixes Serena After Bouncing Venus

Kim Clijsters defeats Serena Williams 6-4, 7-5. Clijsters wins the second set on a point penalty. In the first set, Serena broke her racket, earning herself a code violation warning. In the second set, Serena is called for a foot fault. Apparently, she responds by threatening the line judge. She's dinged with a point penalty, which ends the game.

Seventeen-year-old tennis phenom Melanie Oudin lost to Caroline Wozniacki at the US Open yesterday. Oudin made 43 unforced errors as she lost 6-2, 6-2. There's always next year!

Illegal Immigrants Subsidize Social Security

A federal law that fines employers for hiring illegal immigrants have forced such workers to use false federal identification. Employers also have to put all the workers on the payroll so that Social Security and federal taxes are withdrawn from their salary. Of course, the illegal immigrants cannot draw Social Security upon retirement. The end result is that illegal immigrants are subsidizing Social Security by as much as $7 billion a year. That's the surplus that Social Security currently enjoys.

You can deny illegal immigrants health care if you want, but you can't say that they're lazy or undeserving people. To me, a person who risks his life to enter this country has done more to earn his place here than someone who just happened to be born in the right place. (Illegal immigrants aren't even criminals—it's not a criminal act to overstay a visa.)

Anyway, someone should make a reality TV show based on this concept, no? Survivor: Americas.

Derek Jeter Ties Lou Gehrig

In last night's 4-2 victory over the Rays, Derek Jeter had three hits to tie Lou Gehrig's record of all-time hits leader of the New York Yankees. His first hit of the game was a bunt down the third base line. Jeter is now 54th on baseball's all-time hits leaders.

Rep. Joe Wilson (R) Yells At Obama During Speech

During President Obama's health care reform speech earlier tonight before a joint session of Congress, Representative Joe Wilson, a Republican from South Carolina, yelled, "You lie!"

To their credit, the Republican leadership recognized that Wilson's outburst was inappropriate. Later, Wilson's office issued an apology.

It would be very dismaying if this is the level of discourse that the Republicans are willing to grant the American people.

17-year-old Oudin upsets Sharapova at US Open

The Associated Press reports that Maria Sharapova was defeated by seventeen-year old American Melanie Oudin, 3-6, 6-4, 7-5. Oudin had defeated fourth seed Elena Dementieva in the second round. Oudin is the top American female tennis player who did not spring from the loins of Richard Williams.

Mom Cries At Thought Of Obama's School Speech

Republicans have accused President Obama of trying to brainwash American schoolchildren in his planned back-to-school speech next week. The President plans to tell children to study hard and stay in school. Of course, in the strictest sense, telling kids to pursue an education is a kind of brainwashing, as are most attempts at inculcating children with social values such as "buckle up," "look both ways before crossing the street," and "don't do your homework until you've watched Glenn Beck's show tonight."

But perhaps the parents who fear the upcoming Presidential indoctrination have themselves been victims of brainwashing by the conservative media. For instance, a mother interviewed by CNN broke down into tears at the thought of her child listening to Obama's speech.

Glenn Beck's Secret Communist Art Tour

He's nuts. The biggest problem with his critique is that it's wrong. Mussolini was a fascist who hated communism. You cannot call someone a socialist AND a communist and still make sense, right? But Beck never makes the point he is trying to make about the relationship of decade-old art and Obama's supposed socialism. He says that's something the viewer has to figure out for himself. So basically, he's saying that he'll lead you to the bin of crazy, but you have to drink from it yourself.

GOP Loves Socialist Medicare

The Republican Party is urging President Obama to protect the elderly and their Medicare. As usual, it makes no sense at all. Completely confusing the issues, Republican Chairman Michael Steele demands that President Obama prevent "any government role in end-of-life care. And stop bureaucrats from getting between seniors and their doctors." Mr. Steele is many decades too late in demanding the government step aside from any role in end-of-life care. Medicare already pays for such care for many Americans. In fact, many Americans cannot afford such care without Medicare. And lest you forget, Medicare is a federal program.

The GOP hasn't explained why Medicare is not a socialist medical program that reeks of Nazism. The ranting and raving at the town hall protests would directly apply to Medicare as it is completely funded by the federal government. Texan Justice: A Crapshoot

The Associated Press reports that the state of Texas most likely executed an innocent man for setting a fire that killed his three  young children. The conviction of Cameron Todd Willingham was based on a shoddy arson report that was "nothing more than a collection of personal beliefs that have nothing to do with science-based fire investigation." Mr. Willingham maintained his innocence up to his execution. In a footnote to the article, Ernest Ray Willis was set free after 17 years on death row for an arson conviction. A federal judge ruled that authorities concealed evidence and needlessly drugged him during trial.

Perhaps we should let Texas secede. It can go ahead and become its own third world nation without dragging America down with it.
